Bumble and Oliver's Travels Terms and Conditions

1.SWEEPSTAKES TIMING: The Sweepstakes begins at 17:00 PM Greenwich Mean Time ("GMT") on Monday 1 April 2019 and continues through 11:59:59 PM GMT on Monday 8 April 2019 (the "Sweepstakes Period"). All entries must be received prior to the expiration of the Sweepstakes Period in accordance with the terms and conditions of these Official Rules, and any entries so received thereafter shall be null and avoid, and ineligible for the Sweepstakes.
2. ELIGIBILITY: This Sweepstakes is open only to legal residents of the United Kingdom, who are 25 years of age or older at time of entry. Employees of the Sponsor, their respective affiliates, subsidiaries, advertising and promotion agencies and the immediate family members (i.e., parents, spouse, children, siblings, grandparents, step parents, step children and step siblings) and/or those living in the same household of each are not eligible.
3. HERE'S HOW IT WORKS: To enter: 1) download and install the free official Bumble app (available on the Android and iOS operating systems and available on certain platform operators' storefronts) ("Bumble App") on your mobile device; 2) create a user profile within the Bumble App by completing all of the required fields and complying with any other requirements therein; 3) be a personally-registered account holder of the Bumble App in good standing with a public profile and sign in to the Bumble App; 4) using the Bumble BFF mode, look for the Suitcase x Bumble competition in-app card and follow the instructions to complete the registration form with all of the required information in order to be entered into the Sweepstakes; and 5) electronically acknowledge and agree to Sponsor's Terms of Service, Privacy Policy and any other required terms and policies. A paid subscription to Bumble is not required for Sweepstakes entry.
4. GENERAL ENTRY TERMS AND CONDITIONS: Entrants are limited to one entry per Entrant. If an Entrant uses multiple user accounts to submit more than one entry only the first entry will count. In the event of a dispute over who submitted, or shall be entitled to claim, the winning entry, the authorized account holder of the user account used to participate in the Sweepstakes at the actual time of entry, shall be deemed to be the Entrant. The authorized account holder is defined as the natural person who is assigned the applicable e-mail address or user credentials by an Internet access provider, IP-connected application, online service provider or other organization that is responsible for granting credentials or assigning e-mail addresses for the domain associated with the submitted e-mail address.
5. RANDOM DRAWING: Subject to the terms and conditions set forth in these Official Rules, there shall be one (1) potential prize winner (the "Prize Winner") randomly selected on or about 10th April 2019, from among all eligible entries received by Sponsor. Odds of winning will depend on the number of eligible entries received. The Prize Winner may be requested to provide Sponsor with proof and other substantiating documentation that such person is the potential Prize Winner.
6. NOTIFICATION: The potential Prize Winner will be notified by email using the information provided at the time of entry. If the potential Prize Winner cannot be contacted or does not respond (within seven days of attempted notification), Sponsor reserves the right, in its sole and absolute discretion, to disqualify such potential Prize Winner and, if time permits, to select the next qualifying potential Prize Winner and attempt to contact same, who shall be subject to the same eligibility requirements and disqualification in the same manner as described in these Official Rules. Sponsor shall not be responsible for failed attempts to notify any potential Prize Winner and no responsibility is assumed by Sponsor for any e-mail(s) or other correspondence returned as undeliverable without a forwarding address or any other problems, omissions or technical malfunctions associated with any platform, network, servers, computer equipment, software, applications, the Internet or any combination thereof. Where potential a Prize Winner is notified by email, Sponsor assumes no responsibility for undeliverable email resulting from any form of active or passive filtering by email service providers or for insufficient space in user's account to receive email. Return of any email as undeliverable will result in disqualification and an alternate potential winner will be selected. Return of any prize/prize notification as undeliverable will result in disqualification and an alternate potential Prize Winner will be selected.
7. PRIZE AND RETAIL VALUE: Subject to the terms and conditions set forth in these Official Rules, there shall be one (1) prize for the Sweepstakes, which consists of a three (3) night stay for up to a total of 14 people at Emley Woodhouse, a Grade II listed Georgian country house in Yorkshire, including a champagne welcome hamper on arrival (the "Prize"). The house will be provided by Oliver's Travels, a holiday company. The approximate retail value ("ARV") of the Prize is £2200, and the value of same may vary depending upon market conditions at the time of fulfilment and/or redemption. Any difference between the ARV and the actual value, if any, will not be rewarded.
8. FURTHER PRIZE TERMS: The Prize must be taken by 1 June 2020 and excludes the following dates: 5 July - 6 September 2019, 18 October - 28 October 2019 and 20 December 2019 - 3 Jan 2020. The Prize and all its elements are subject to availability. In the unlikely event that the villa is no longer available with Oliver's Travels a replacement villa will be provided of equal or greater value. Dates for the use of the Prize are subject to availability. Changeover day is a Friday. There is a security deposit of £500 payable for groups of up to 7, and £1,000 for between 7-14 guests. This will be a credit card authorisation and will be released in full after use of the Prize, subject to a damage inspection on departure. The Prize does not include travel insurance, the cost of transfers to and from airports or stations, food and drink, spending money, tax or personal expenses. Any other costs incurred in addition to those set out above and that are incidental to the fulfilment of the Prize are the responsibility of the Prize Winner. The Prize and its components are non-transferable and no cash alternative or other substitute is available.
9. PUBLICITY: If you are the winner of the competition, you agree that the Promoter may use your name, image and town or county of residence to announce the winner of this competition and for any other reasonable and related promotional purposes. You further agree to participate in any reasonable publicity required by the Promoter. By entering the competition, you agree that any personal information provided by you with the competition entry may be held and used only by the Promoter or its agents and suppliers to administer the competition. Upon the request of Sponsor (at Sponsor's discretion), the potential Prize Winner must sign and return the following documents in order to be eligible to receive a Prize: (i) an affidavit of eligibility; (ii) a publicity/liability release granting the right to use each potential Prize Winner's name and likeness for advertising, marketing and publicity purposes; and (iii) any other releases and waivers requested by Sponsor, in each instance (i.e., subsections (i), (ii) and (iii) above), releasing the Sponsor Entities (as defined below) from any and all liability, loss, claims, demands, and causes of action for or related to (a) personal injury, damage, theft, loss, or any other harm suffered in connection with the Sweepstakes or the receipt and/or use of any Prize (or any component thereof); and (b) publicity rights, defamation, invasion of privacy, intellectual property and any other personal, proprietary or property rights of any party and/or any related cause of, including, the use/misuse and/or acceptance of any Prize (or any component thereof); (collectively, the "Sweepstakes Documentation"). By entering into the Sweepstakes, each Entrant agrees to promptly sign and return any and all of the Sweepstakes Documentation in accordance with the requirements, criteria, parameters and timing described herein or otherwise designated by Sponsor.
10. PRIZE TERMS AND RESTRICTIONS: Reporting and payment of all applicable taxes, fees, and/or surcharges, if any, arising out of, or resulting from, acceptance or use of any Prize, are the sole responsibility of the Prize Winner. No substitution or transfer of prize by winners is permitted. Only the Prize as described in these Official Rules shall be awarded and no substitutions, cash equivalents and/or redemptions shall be made, except that Sponsor reserves the right to substitute any prize (or any component thereof) for another prize of equal or greater value, in the event that the applicable Prize (or any component thereof) is not available. Each Entrant in the Sweepstakes shall be eligible to win no more than one Prize. Acceptance of the Prize constitutes permission to the Sponsor Entities to use the winner's name, voice and/or likeness for purposes of advertising and trade without further compensation, unless prohibited by law. By participating in this Sweepstakes, entrants agree to be bound by these Official Rules and the decisions of Sponsor. The Sponsor Entities expressly disclaims any responsibility or liability for injury or loss to any person or property relating to the delivery, receipt and subsequent use and redemption of any Prize (or any component thereof). The Prize restrictions and conditions set forth herein are not exhaustive and additional restrictions and conditions may apply, and the Sponsor Entities make no representations or warranties (express or implied) concerning the appearance, safety, features, usage, accuracy or performance of any Prize. The Sponsor Entities shall not be liable for nor replace any lost, stolen, damaged or malfunctioning element of any Prize.
11. ENTRY CONDITIONS: By entering and/or participating in the Sweepstakes, each Entrant agrees: (a) to be bound by and comply with (i) all of the terms and conditions set forth in these Official Rules; (ii) the interpretations of these Official Rules by Sponsor and by the decisions of Sponsor, which are final in all matters relating to the Sweepstakes; (iii) Sponsor's Terms of Use and Privacy Policy; and (iv) any other applicable terms and conditions promulgated by the Sponsor (as defined below); and (b) to release and hold Sponsor and its affiliates, and their respective agents, employees, officers, directors, successors and assigns, and any suppliers, licensors, donors, sponsors, operators, service providers, vendors, marketing partners and other affiliated parties in connection with the Sweepstakes (collectively, the "Sponsor Entities") harmless against any and all claims, injury, damage or liability arising out of or relating to participation in this Sweepstakes and/or use or misuse or redemption of any Prize (as defined herein), including without limitation any claims for personal injury (including death), property damage, or violation of any intellectual property, privacy, publicity and/or any other personal, proprietary or property rights of any party and/or any related cause of action. The Prize Winner assumes all liability for any injury or damage caused, or claimed to be caused by participation in this Sweepstakes or use or redemption of any prize. CLAIMS MAY NOT BE RESOLVED THROUGH ANY FORM OF CLASS ACTION. Sponsor shall not be responsible for errors, omissions, interruptions, deletions, defects (in part or in whole), delays in operations, transmissions, theft, or destruction or unauthorized access to or alternations of any entry correspondence, transmissions or other materials in connection with the Sweepstakes or in the announcement of the prizes. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any sweepstakes materials and the terms and conditions of the Official Rules, the Official Rules shall prevail, govern and control. No more than the number of prizes stated in these Official Rules shall be awarded. Any attempted submissions or entries in connection with the Sweepstakes that are lost, late, misdirected, incorrect, garbled, or incompletely received, for any reason, including, by reason of platform, hardware, software, browser, or network failure, malfunction, congestion, or incompatibility on any servers or otherwise shall not be counted or eligible for the Sweepstakes, as determined by Sponsor, in its sole and absolute discretion.
12. POSTING TERMS; RESTRICTIONS; LICENSE:(a) In order to promote, market and publicize the Sweepstakes, the Sponsor Entities and certain other related initiatives, entities and services, the Sponsor Entities require a license to use any and all information, materials and content posted, made available or submitted in connection with each Entrant's participation in the Sweepstakes, including each Entrant's name (and likenesses), user names, biographical information and any other personal information (collectively, "Postings"). By way of example and by no means limitation, the Postings may be used in connection with Entrant lists, news feeds, emails, notifications, message boards, forums, blogs, blasts, online social community network profiles/groups/platforms, periodicals, magazines, news reports, websites, programming channels, broadcast and any other means of public display and performance, and other uses which may incorporate the Sponsor Entities and/or other affiliated parties' property and branding (including promotional materials such as banners, photos, logos, trademarks, audio-visual content, etc (collectively, the "Sponsor Materials"). (b) Accordingly, each Entrant hereby expressly grants the Sponsor Entities a worldwide, perpetual, irrevocable, royalty-free, fully-paid, non-exclusive, sublicensable and transferable right and license to use, reproduce, encode, store, copy, transmit, publish, post, broadcast, display, publicly perform, exhibit, create derivative works, modify and promote any and all Postings in, on, through and in connection with any and all now known or hereafter devised, discovered or developed forms of media, products, platforms and services, without notice and without compensation, right of inspection, royalty, accounting, liability or obligation of any kind to any Entrant or any other third party. (c) All contents of the Postings, with the exception of any incorporated Sponsor Materials, must be completely original to each Entrant and must not have been taken or composed in whole or in part from any other source, including all graphical, audio-visual elements, imagery and artwork appearing in the Postings, and must be free and clear of any liens or claims with respect to the use of the Postings, and that such use will not give rise to any claims or infringement, invasion of privacy or publicity, or claims for any payment whatsoever including, but not limited to, claims for re-use fees or residuals. (d) All Entrants agree that any and all Postings made during the Sweepstakes Period or in connection with the Sweepstakes shall not contain, include or involve (or be posted on any websites highlighting or featuring) any of the following: ● obscenity; ● crude, vulgar or offensive pictures, depictions, images, language and/or symbols; ● gang signs or symbols; ● gratuitous violence, guns or other imagery or gestures of weapons. Violence may not be used to stimulate the audience or to invite imitation, nor may it be shown or offered as an acceptable solution to problem or conflict; ● nudity or explicit, graphic or excessive sexual activity; ● commercial products (e.g., clothing, toys, food) and/or their trademarks, brands, logos or endorsements other than the Sponsor Materials; ● trade libel; ● hard liquor use or product images; ● license plates, phone numbers, personal addresses - physical or email or otherwise; ● illegal drug or alcohol use or abuse; ● derogatory characterizations of any ethnic, racial, sexual or religious groups, humiliation of other people (publicly or otherwise), or any assault or threatening of others; ● violation of anyone's right of privacy, including any statements that may be true but of private facts; ● trespass or the violation of other people's rights or property; ● illegal (e.g., discriminatory, harassing) or inappropriate activity, behavior or conduct (e.g., inflicting emotional distress); ● defamatory, libelous, threatening or other material that advocates against any individual or group including products/services promoting discriminatory behavior (e.g., racial, religious, gender, nationality, sexual orientation); ● conduct or activities in violation of these Official Rules; or ● any other content, display, materials and/or images that is or could be considered inappropriate, unsuitable or offensive, as determined by the Sponsor Entities, in their sole discretion. In addition, each Entrant agrees, confirms and represents to the Sponsor Entities that such Entrant has not engaged or taken part in (or induced or encouraged anyone else to do so) in any activity or conduct in connection with the Sweepstakes that: (i) is or may constitute a crime, unlawful or non-consensual activities (e.g., conduct that could lead to criminal prosecution), tortious conduct (e.g., conduct that could lead to civil prosecution) or the violation or infringement of the rights of any other party; or (ii) violates any of the terms or conditions of these Official Rules.
13. GENERAL RULES: Any violation of these Official Rules may result in disqualification. Sponsor reserves the right to reject any entries in the Sweepstakes or any Entrant's activities associated therewith that may be deemed, in its sole and absolute discretion, to violate these Official Rules, and/or any policies or guidelines established by Sponsor that govern Entrants' participation in the Sweepstakes. If these Official Rules conflict with or otherwise differ from any promotional or other materials published or made available in connection with the Sweepstakes, these Official Rules shall control. The section headings in these Official Rules are for convenience only and are not to be considered in construing or interpreting these Official Rules. The terms "include," "includes," and "including," whether or not capitalized, mean "include, but are not limited to," "includes, but is not limited to," and "including, but not limited to," respectively and are to be construed as inclusive, not exclusive. ANY VIOLATION OF THESE OFFICIAL RULES BY A PRIZE WINNER OR ANY BEHAVIOUR BY A PRIZE WINNER THAT SHALL BRING SUCH PRIZE WINNER OR SPONSOR INTO DISREPUTE (IN THE SPONSOR'S SOLE AND ABSOLUTE DISCRETION) SHALL RESULT IN SUCH PRIZE WINNER'S DISQUALIFICATION AS A PRIZE WINNER FROM THE SWEEPSTAKES AND ALL PRIVILEGES AS A PRIZE WINNER SHALL BE IMMEDIATELY TERMINATED. Proof of submission is not proof of receipt. Sponsor is not responsible for incomplete, lost, late, damaged, illegible or misdirected mail/e-mail or for any technical problems, malfunctions of any telephone lines, computer systems, servers, providers, hardware/software, lost or unavailable network connections or failed, incomplete, garbled or delayed computer transmission or any combination thereof. Sponsor is not responsible for any damage to any participant's computer system/software related to or resulting from participation or downloading any materials in this promotion. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS PROMOTION IS A VIOLATION OF LAW. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO DISQUALIFY AND SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. If an entrant submits more than the stated number of entries permitted, and/or if the Sponsor suspects that an entrant attempted to obtain additional entries by using multiple email addresses, identities or any other method, all entries submitted by the entrant will be declared null and void. Any suspected use of robotic, automatic, programmed, or the like methods of participation will void all such submissions by such methods. Sweepstakes may be cancelled, modified, terminated or suspended if infected by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes outside control of Sponsor which impairs or affects the administration, security, fairness, integrity, or proper conduct of the sweepstakes. Sponsor reserves the right at its sole discretion to disqualify any individual who tampers with any entry process or who harasses any other entrant or any Sponsor representative and to cancel, modify, terminate or suspend the Sweepstakes. In the event of termination, a random drawing will be held from all eligible entries received prior to the time of termination. Entrants agree to indemnify and hold harmless the Sponsor Entities from any and all liability resulting or arising from Entrant's acts or omissions in connection the Sweepstakes, to release all rights to bring any claim, action or proceeding against the Sponsor Entities from any and all liability resulting or arising from the Sweepstakes and hereby acknowledge that the Sponsor Entities have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to the Prizes.
14. DISPUTES/GOVERNING LAW: These terms and conditions shall be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England. In the event of any dispute which cannot be resolved between the parties, any claim and cause of action arising out of or connected with the Sweepstakes, or the Prize awarded, under no circumstances shall any Entrant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental or consequential damages, or any other damages, including legal fees, other than Entrant's actual out-pocket expenses (e.g., costs associated with entering the Sweepstakes).
15. Sponsor is: Suitcase Magazine, with registered office at Enticknap & Co, The Old Store The Street, Wonersh, Guilford, Surrey, England, GU5 0PF, and Bumble Holding Limited, with registered office at The Broadgate Tower, Third Floor, 20 Primrose Street, London EC2A 2RS.
16. Sponsor may be collecting personal data about entrants online, in accordance with its privacy policy. Please review the Sponsor's privacy policies at Enticknap & Co, The Old Store The Street, Wonersh, Guilford, Surrey, England, GU5 0PFin the case of Suitcase Magazine) and https://bumble.com/privacy (in the case of Bumble Holding Limited). By participating in the Sweepstakes, and subject to the terms and conditions of these Official Rules, each Entrant hereby agrees to Sponsor's collection and usage of their personal information and acknowledge that they have read and accepted Sponsor's privacy policies.
17.Prize is a three-night stay for up to 14 guests at Emley Woodhouse including champagne welcome hamper on arrival.
18. Prize must be taken by 1 June 2020 and excludes the following dates: 5 July - 6 September 2019, 18 October - 28 October 2019 or 20 December 2019 - 3 Jan 2020.
19. Winner must be over the age of 25.
20. Dates are subject to availability; changeover day is a Friday.
21. There is a security deposit of £500 for groups of up to 7, and £1,000 for between eight to 14 guests. This will be a credit card authorisation and will be released in full subject to a damage inspection on departure.
22. Winner will be chosen at random and will be contacted by email and they will have seven days to claim the prize. After which if not claimed, another winner will be chosen at random.
23. The prize excludes travel and all other costs and arrangements not expressly included in the prize.
24. The prize and its components are non-transferable and no cash alternative or other substitute is available.
25. The prize and all its elements are subject to availability. In the unlikely event that the villa is no longer available with Oliver's Travels a replacement villa will be provided of equal or greater value.
26. The promoters will use any data submitted by entrants for the purposes of running the competition, unless otherwise stated in the entry details. By entering this competition, all entrants consent to the use of their personal data by the promoters for the purposes of the administration of this competition and any other purposes to which the entrant has consented.
27. The winner will be contacted by Oliver's Travels to choose a suitable date for the trip.
28. To obtain details of the outcome of the competition please email [email protected] stating the name of the competition in the subject heading up to four weeks after the closing date.
29. By entering the competition each entrant agrees to be bound by these terms and conditions.
30. These terms and conditions are governed in accordance with the laws of England and Wales.
31. Release: By participating, entrants agree to release and hold harmless the co-sponsors, administrator, and their respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and prize. suppliers, and each of their respective parent companies and each such company's officers, directors, employees and agents from and against any claim or cause of action, including, but not limited to, property damage, personal injury and/or death which may occur in connection with, preparation for, travel to, or participation in the competition, or possession, acceptance and/or use or misuse of prize or participation in any competition-related activity and for any claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trademark infringement or any other intellectual property-related cause of action.
